In the following terms and conditions, 'we', 'our', or 'us' means LGC Hosting,
and 'you', 'your' or 'the customer' means you the subscriber to our services.
'Services', or 'account' refers to services provided by us to you.
Terms of Service
These terms apply to domain name registration and internet web hosting services
provided by LGC Hosting.
Accounts are to be used by the primary owner only. Account holders are not
permitted to resell, store or give away web-hosting services of their website
to other parties. Web hosting services are defined as allowing a separate,
third party to host content on the owner's web site. Exceptions to this include
ad banners, classified ads, and personal ads.
We reserve the right to suspend or terminate any account or service at our sole
discretion.
Web do not allow any of the following content to be stored on our servers:
Illegal Material - This includes copyrighted works, commercial audio, video, or
music files, and any material in violation of any UK or International
regulations.
Adult Material - Includes all pornography, erotic images, or otherwise lewd or
obscene content. The designation of "adult material" is left entirely to the
discretion of LGC Hosting.
Warez - Includes pirated software, ROMS, emulators, phreaking, hacking,
password cracking. IP spoofing, etc., and encrypting of any of the above. Also
includes any sites which provide "links to" or "how to" information about such
material.
Email use policy
You may not use our internet services to promote, distribute or advertise:
Spam email, Unsolicited Commercial Email (UCE) or Unsolicited Bulk Email (UBE),
including bulk email software and lists of email addresses, except where all of
the addressees have given their permission.
Illegal activities and activities deemed to be in breach of the Data Protection
Act.
Bandwidth use policy
All LGC Hosting accounts come complete with a set limit per month of bandwidth
usage, additional bandwidth use is charged at our advertised rates.
Payment policy
All accounts are set up on a prepay basis. Although LGC Hosting reserves the
right to change prices of accounts or services at any time all pricing is
guaranteed for the period of prepayment. Payment is due each anniversary year
or month following the date the account was established. Customers will
automatically be billed again at the end of their prepay period unless closure
notification has already been given.
We reserve the right to suspend your service until any outstanding debt is
cleared. The customer is responsible for all money owed on the account from the
time it was established to the time that the customer sends a written
cancellation request.
All payment is in UK sterling.
We reserve the right to take legal action to recover any debts and apply an
administration charge for late or non-payment of an account. This fee shall not
exceed £150 plus the amount outstanding.
Payment options
Credit/Debit Cards: We currently accept Visa or MasterCard.
PayPal: You can make payments through your PayPal account.
Cheque Payment: Cheque payments must be sent immediately after you place
an order. We reserve the right to withold our service until payment has been
received.
Cancellation and refunds
We reserve the right to cancel the service at any time. In this event customers
will be entitled to a pro rata refund based upon the remaining period of
membership. If a customer contravenes LGC Hosting's terms of service a refund
will not be issued in the event of a cancellation.
Fees charged on a prepay basis are non-refundable.
Indemnification
You agree to indemnify LGC Hosting from any and all demands, liabilities,
losses, costs and claims, including reasonable legal fees asserted against LGC
Hosting, its agents, its customers, officers and employees, that may arise or
result from any service provided or performed or agreed to be performed or any
product sold by you, your agents, employees or assigns.
You also agree to indemnify LGC Hosting against liabilities arising out of;
i) any injury to person or property caused by any products sold or otherwise
distributed in connection with LGC Hosting's hosting service,
ii) any material supplied by customer infringing or allegedly infringing on the
proprietary rights of a third party, iii) Copyright infringement and iv) any
defective products sold to customer from LGC Hosting's hosting service.
Disclaimer
We will not be responsible for any damages your business may suffer. LGC
Hosting makes no warranties of any kind, expressed or implied for services we
provide. We disclaim any warranty or merchantability or fitness for a
particular purpose. The includes loss of data resulting from delays,
non-deliveries, wrong delivery, and any and all service interruptions caused by
LGC Hosting and its employees. LGC Hosting reserves the right to revise its
policies at any time.
If any part of these terms and conditions or any associated Acceptable Use
Policies shall be held invalid or unenforceable, this shall not affect the
enforceability of any other part of these terms and conditions and Acceptable
Use Policies.
